Membership Terms and Conditions

1. About these Terms

These terms and conditions apply to your membership of The MAD Academy.

The MAD Academy is operated by Metabolix Ltd, a company registered in England and Wales under company number 15070218. In these Terms, “we”, “us” and “our” mean Metabolix Ltd, and “you” and “your” mean the person purchasing the membership.

Your contract with us is formed when we accept your order and confirm your membership by email.

2. Your Membership

Your membership includes personalised training programming, nutrition and meal planning, and race weekend preparation.

Monthly and annual memberships provide the same service. They differ only in price and billing period.

Training and nutrition are made available through your account on a rolling seven-day basis.

Race weekend preparation is made available 14 days before the first day of the relevant event, or immediately if the event is already within that 14-day period.

An annual membership does not provide access to a full year of programmes in advance.

Your whole race calendar is used to place you in the appropriate training phase and build your programme, regardless of when you join.

Your programme is based on the information you provide to us. You are responsible for keeping your profile, race calendar and other information relevant to your programme accurate and up to date.

3. Price and Payment

Membership costs £99 per month or £990 per year.

All prices are in pounds sterling and include any applicable taxes.

Payment is taken when you join. By purchasing a membership, you authorise us and our payment provider to take recurring payments using your chosen payment method until your membership is cancelled.

If a payment cannot be collected when due, we may suspend access to your membership until payment is received.

4. Renewal

Monthly memberships renew automatically each month.

Annual memberships renew automatically every 12 months.

Your membership will continue to renew until you cancel it.

Your next renewal date will be shown in your account.

If we change the price of your membership, we will give you reasonable notice before the new price takes effect. The new price will apply from your next renewal and will not affect any membership period you have already paid for.

5. Cancelling Your Membership

You may cancel your membership at any time through your account, by emailing support@themadacademy.com or by using our model cancellation form.

There is no notice period.

If you cancel, your membership will remain active until the end of the period you have already paid for. It will then end and no further membership payment will be taken.

Payments for a membership period that has already started are not refundable because you choose to cancel part-way through that period, except where you exercise your 14-day cancellation right or otherwise have a legal right to a refund.

6. Your 14-Day Cancellation Right

You have the right to cancel your membership without giving a reason within 14 days beginning on the day after your contract with us is formed.

If you ask us to start providing your membership during this 14-day period, we will start providing the service immediately.

If you then cancel within the 14-day period, we will refund the amount you paid less a proportionate amount for the service provided up to the time you cancel.

To exercise your right to cancel, you must clearly tell us that you wish to do so. You may cancel through your account, email support@themadacademy.com or use the model cancellation form provided when you join. You do not have to use the model cancellation form.

Any refund due will be made within 14 days after you tell us that you wish to cancel, using the same payment method you used to pay unless you agree otherwise.

Nothing in these Terms affects your statutory rights.

7. Your Account

Your membership is personal to the rider for whom it was purchased.

You must provide accurate information and keep your login details secure.

You must not share your account or allow another person to use your membership.

We may suspend or terminate an account where there has been non-payment, fraudulent use, serious misuse of the service or a serious or repeated breach of these Terms.

If we terminate your membership for a reason that is not caused by your breach of these Terms, we will refund you for any part of a paid membership period that you will not receive.

When your paid membership ends, we stop releasing new plans. Your own results, logs and history are not deleted solely because you cancel. You can download your information or ask us to delete it in accordance with our Privacy Notice.

8. Intellectual Property

All intellectual property rights in The MAD Academy and in the training programmes, training plans, nutrition plans, meal plans, race preparation plans, software, content, branding and other materials provided as part of the service are owned by, or licensed to, Metabolix Ltd.

We grant you a personal, non-exclusive and non-transferable licence to access and use those materials for the rider’s own training, nutrition and race preparation.

You may download, save or print materials where the service allows you to do so and may continue to use those copies for the rider’s own purposes after the membership ends.

You must not share, sell, distribute, publish, reproduce or otherwise make our materials available to another person, except for your own personal use, without our prior written permission.

You must not resell access to the service or use our materials to create or provide a competing service.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

9. Health and Training

The MAD Academy provides training, nutrition and performance guidance. It does not provide medical advice, diagnosis or treatment and is not a substitute for advice from an appropriately qualified healthcare professional.

You are responsible for ensuring that the rider is fit to undertake the training and nutritional programme provided.

Appropriate medical or professional advice should be obtained before starting or continuing the programme if the rider is injured, unwell, pregnant, has a medical condition or has any other health concern that may affect their ability to train or follow nutritional guidance safely.

The rider should stop training and seek appropriate advice if they experience symptoms that may indicate illness or injury or make it unsafe to continue.

The service relies on the information you provide. You are responsible for ensuring that information relevant to the programme is accurate and kept up to date.

Training, nutrition and sporting outcomes depend on many factors outside our control. We do not guarantee any particular fitness, body composition, racing or performance result.

10. Riders Aged 12 to 17

A rider under the age of 18 may not purchase or manage their own membership.

Where the rider is aged 12 to 17, the membership must be purchased and managed by their parent or legal guardian. The parent or legal guardian enters into the contract with us and accepts these Terms on the rider’s behalf.

The parent or legal guardian must also complete the separate parent consent process and read the parent and rider privacy notice before the rider’s programme begins.

When the rider turns 18, we may transfer responsibility for the membership and account to them.

11. Changes to the Service

We may make reasonable changes to The MAD Academy and the way the service is provided, including changes needed to improve the service, maintain security or technical compatibility, or comply with legal or regulatory requirements.

We will not materially reduce the service during a period you have already paid for without giving you reasonable notice.

If a change materially disadvantages you during a paid membership period, you may cancel and we will refund the amount paid for any part of that period you will not receive.

12. Our Responsibility to You

We will provide the service with reasonable care and skill.

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage caused by inaccurate or incomplete information provided to us, or by using the service in a way that is contrary to the guidance provided, except to the extent that the loss or damage was caused by us.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these Terms affects your statutory rights as a consumer.

13. Personal Information

We process personal information in accordance with our Privacy Notice.

Our Privacy Notice explains what information we collect, how and why we use it, how long we keep it and the rights available to you.

14. Changes to these Terms

We may update these Terms where reasonably necessary to reflect changes to the service, our business or applicable law or regulation.

If a change materially affects your rights or obligations, we will tell you before it takes effect.

A change will not alter the terms applying to a membership period you have already paid for unless the change is required by law.

If you do not agree to a change that will apply from your next renewal, you may cancel your membership before that renewal.

15. Governing Law

These Terms and your contract with us are governed by the law of England and Wales.

If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may also bring legal proceedings in Scotland. If you live in Northern Ireland, you may also bring legal proceedings in Northern Ireland.

If you live outside the United Kingdom, you may also have rights under the mandatory consumer laws of the country in which you live. Nothing in these Terms affects those rights where they apply.
